1. Introduction

Welcome to SharedInformationPool ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at sharedinformationpool.sbs (the "Service") operated by SharedInformationPool.

By booking a charter or accessing our Service, you consent to be bound by these Terms. Should you object to any of these terms, you must refrain from using the Service.

2. Service Overview

SharedInformationPool offers a range of exclusive yacht charter services, among which are:

• Yacht rentals for the day
• Evening boat tours
• Company outings
• Events held privately
• Prolonged yacht charters

Service availability is dependent on both schedule and weather conditions. We retain the authority to alter or cease services at our discretion.

3. Booking and Reservations

3.1 Booking Process

To secure a charter, the following is required:

• Attainment of at least 18 years of age
• Submission of precise and complete particulars
• Remittance of the necessary deposit as stipulated in your booking confirmation
• Acceptance of these Terms & Conditions

3.2 Confirmation

Confirmation of your booking is established only upon the successful processing of payment and our subsequent written confirmation. We maintain the right to deny service at our sole discretion.

3.3 Availability

Charter opportunities are contingent upon the availability of vessels and agreeable weather conditions. We will endeavor to meet your requested schedule preferences to the best of our ability.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and incorporate all applicable taxes unless stated otherwise. Prices are subject to modification without prior notice.

4.2 Payment Schedule

• Initial Deposit: 50% of the overall charter fee is required at the time of booking
• Final Payment: To be made 48 hours before the scheduled departure of the charter
• Incidental Expenses (if any): Payable upon the conclusion of the charter

4.3 Payment Methods

We support payments through major credit cards, bank wire transfers, and certified bank drafts. Secure, encrypted procedures are employed for handling payment processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• A cancellation made over 72 hours before departure will result in a complete refund minus any applicable processing fees
• Cancellation from 24 to 72 hours before departure will result in a 50% refund
• No refund will be issued for cancellations made less than 24 hours prior to departure

5.2 Weather Cancellations

In the event of unfavorable weather conditions as determined by our captain, we will offer the choice to:

• Rebook the charter for the soonest available slot without any additional charges
• Issue a complete refund in the instance where rescheduling is unfeasible

5.3 Mechanical Issues

Should there be mechanical difficulties with the yacht designated for your charter, we will attempt to supply an appropriate substitution. In the absence of a suitable alternative, we will provide a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are expected to:

• Adhere to all instructions from the crew
• Utilize any safety gear provided when instructed to do so
• Inform of any health issues that might compromise their security
• Stay within specifically designated areas aboard the vessel

6.2 Prohibited Items

Guests are prohibited from bringing the following onto the yacht:

• Containers made of glass
• Unlawful substances
• Guns or other forms of weaponry
• Excessive quantities of beverages (beyond a reasonable quota for personal use)
• Pets (except when prior authorization has been granted)

6.3 Conduct

Passengers must behave respectfully at all times. We reserve the prerogative to end a charter prematurely without a refund if a passenger's actions present a danger to safety or disturb the enjoyment of others on board.

7. Liability and Insurance

7.1 Our Liability

Our responsibility is confined to the sum paid for your charter. We are not liable for:

• Injuries to persons caused by their own neglect
• The loss or destruction of personal property
• Indirect, incidental, or punitive losses
• Delays result from weather or other circumstances not under our control

7.2 Insurance Coverage

Our vessels and operations are covered by extensive marine insurance. It is the passengers' responsibility to secure their own personal and travel insurance coverage.

7.3 Assumption of Risk

By participating in our yacht charters, you agree to the inherent risks associated with marine activities and volunteer to take accountability for your own safety and security.

8. Modifications and Itinerary Changes

Itineraries, voyage paths, or schedules are subject to adjustments based on meteorological conditions, safety requirements, or operational exigencies. We will endeavor to provide alternative experiences of comparable value whenever necessary.

9. Force Majeure

We shall not be held responsible for delays, cancelling, or modifications to services due to circumstances outside of our control, inclusive of but not limited to:

• Extreme weather
• Natural calamities
• Regulatory edicts
• Port shutdowns
• Mechanical breakdowns

10. Privacy and Data Protection

Your private data is processed in alignment with our Privacy Policy. Your use of our services constitutes agreement to our data collection and usage as detailed in our Privacy Policy.

11. Intellectual Property

The intellectual content on our website, which includes written text, imagery, trademarks, and logos, is protected by copyright and intellectual property laws. Unauthorized reproduction, dissemination, or creation of derivative works is prohibited without our explicit written authorization.

12. Governing Law

These Terms are under the jurisdiction of the laws in Spain. Any contentions will be resolved in the courts of Barcelona, Spain.

13. Changes to Terms

We reserve the rights to amend these Terms when necessary. Any revisions will be communicated via our website along with a revised date of effect. Continued patronage of our services implies acceptance of the updated terms.
